TruLight Texas Terms of Service www.trulighttexas.com Effective Date: February 21, 2026 Please read these Terms of Service ("Terms") carefully before using the website or services provided by TruLight Texas ("Company," "we," "us," or "our"). By accessing our website at www.trulighttexas.com or entering into a service agreement with TruLight Texas, you ("Customer" or "you") agree to be bound by these Terms. If you do not agree, please do not use our website or services. 1. Services TruLight Texas is a licensed lighting contractor specializing in the design, installation, and maintenance of permanent LED outdoor accent lighting systems for residential and commercial properties in Texas. Our services include but are not limited to: • Consultation, design, and planning of permanent LED lighting systems • Supply of materials, fixtures, and LED lighting components • Professional installation of permanent outdoor accent lighting • System programming, configuration, and control setup • Warranty service, repairs, and ongoing maintenance 2. Quotes, Proposals & Acceptance All quotes and proposals provided by TruLight Texas are valid for 30 days from the date of issuance unless otherwise stated in writing. A project will not be scheduled or commenced until a signed proposal or contract and the required deposit have been received by TruLight Texas. Quotes are based on information provided by the Customer at the time of consultation and are subject to adjustment if actual site conditions differ materially from those represented. 3. Pricing & Payment Terms 3.1 Deposits A deposit of 50% of the total project cost is required to secure your installation date. The remaining balance is due upon completion of the installation, prior to final system activation and handoff. 3.2 Accepted Payment Methods We accept cash, check, ACH bank transfer, and major credit cards. Credit card payments may be subject to a processing fee, which will be disclosed at the time of payment. 3.3 Late Payments Balances not paid within 10 days of the due date are subject to a late fee of 1.5% per month (18% per annum) on the outstanding balance. TruLight Texas reserves the right to suspend warranty services and ongoing maintenance for accounts with outstanding balances. 4. Installation & Site Access Customer agrees to provide TruLight Texas and its employees or subcontractors with safe and reasonable access to the property on the scheduled installation date(s). Customer is responsible for: • Ensuring pets, children, and bystanders are kept away from work areas during installation • Disclosing any underground utilities, irrigation systems, or other obstructions that may affect installation • Obtaining any necessary homeowner association (HOA) approvals or local permits prior to installation, unless otherwise agreed in writing TruLight Texas will take reasonable care to minimize disruption to landscaping, lawns, and property during installation. However, we are not liable for minor disturbance to grass, mulch, or soil that is inherent in the installation process. 5. Warranty 5.1 Labor Warranty TruLight Texas warrants all installation labor for a period of 2 years from the date of project completion. This warranty covers defects in workmanship, including faulty wiring connections, improper mounting, or other installation-related issues. 5.2 Product & Manufacturer Warranty All LED fixtures, controllers, and components are covered by the applicable manufacturer's warranty, which varies by product. TruLight Texas will assist Customers in filing warranty claims with manufacturers on their behalf where applicable. 5.3 Warranty Exclusions Warranties do not cover damage caused by: • Acts of God, including but not limited to hail, floods, lightning, or severe weather • Vandalism, theft, or misuse • Unauthorized modifications or repairs by third parties • Damage resulting from construction, landscaping, or other contractor work on the property after installation • Power surges or improper electrical supply not provided by TruLight Texas 6. Changes & Cancellations Customers may request changes to a project scope prior to commencement of installation. Changes may result in revised pricing and scheduling. Change requests must be submitted in writing and approved by TruLight Texas before work proceeds. If a Customer cancels a confirmed project before installation begins, the deposit may be forfeited in whole or in part to cover scheduling, material procurement, and administrative costs incurred by TruLight Texas. Cancellations within 72 hours of the scheduled installation date will forfeit the full deposit. 7. Intellectual Property All lighting designs, system configurations, programming schemes, and creative concepts developed by TruLight Texas are the intellectual property of TruLight Texas. Customers receive a license to use the installed system for personal or commercial use on the subject property but may not replicate, resell, or transfer the design to third parties without written consent from TruLight Texas. 8. Limitation of Liability To the maximum extent permitted by applicable Texas law, TruLight Texas's total liability to Customer for any claims arising out of or related to the services shall not exceed the total amount paid by Customer for the project giving rise to the claim. TruLight Texas is not liable for any indirect, incidental, consequential, or punitive damages, including loss of use, loss of business, or property damage beyond the scope of direct installation-related issues. 9. Indemnification Customer agrees to indemnify, defend, and hold harmless TruLight Texas and its owners, employees, agents, and subcontractors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) Customer's misuse of the lighting system; (b) Customer's failure to disclose known site hazards or conditions; or (c) Customer's breach of these Terms. 10. Privacy Policy TruLight Texas collects Customer information (name, address, email, phone number, and payment information) solely for the purpose of providing services and communicating about your project. We do not sell or share your personal information with third parties except as necessary to complete your installation (e.g., material suppliers) or as required by law. Website Use The TruLight Texas website (www.trulighttexas.com) is provided for informational purposes. All content, images, and materials on the website are owned by TruLight Texas and protected by applicable copyright law. Governing Law & Dispute Resolution These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. We are committed to working in good faith to address issues promptly and fairly. 13. Modifications to These Terms TruLight Texas reserves the right to update or modify these Terms at any time. Updated Terms will be posted to www.trulighttexas.com with a revised effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms. 14. SMS Messaging Terms & Conditions By providing your mobile phone number and opting into SMS communications from TruLight Texas, you agree to the following SMS Messaging Terms and Conditions. These terms apply in addition to the general Terms of Service above. 14.1 Description of SMS Use Cases TruLight Texas may send SMS text messages to customers and prospective customers who have opted in to receive communications. SMS messages may be used for the following purposes: ● Appointment confirmations and installation scheduling reminders ● Project updates, crew arrival notices, and completion notifications ● Payment reminders and invoice notifications ● Warranty service reminders and seasonal maintenance alerts ● Promotional offers, seasonal lighting specials, and new service announcements ● Customer satisfaction follow-ups and review requests 14.2 Opt-Out Instructions You may opt out of receiving SMS messages from TruLight Texas at any time. To unsubscribe, simply reply STOP to any SMS message you receive from us. You may also text CANCEL, QUIT, or UNSUBSCRIBE to be removed from our messaging list. Upon receipt of your opt-out request, you will receive a one-time confirmation message and will not receive any further SMS messages from TruLight Texas unless you choose to re-subscribe. TruLight Texas is not responsible for any delays, failures, or errors in the transmission of SMS messages caused by your mobile carrier or any third-party service provider. Delivery of SMS messages is subject to effective transmission by your carrier, and TruLight Texas cannot guarantee the delivery, timeliness, or security of any SMS message once it has been submitted for transmission. 14.6 Age Restriction (18+) SMS messaging services from TruLight Texas are intended for individuals who are 18 years of age or older. By opting into our SMS program, you represent and warrant that you are at least 18 years old and are the account holder or have authorization to use the mobile number provided. TruLight Texas reserves the right to terminate SMS messaging to any individual who does not meet this age requirement. 14.7 Privacy Policy Your privacy is important to us.
